Vigtige regler for ejerforeninger

Få jeres vedtægter opdateret

Vedtægterne i ejerforeninger udgør det juridiske grundlag for ejerforeninger og regulerer ejerforeningen og dennes medlemmers rettigheder og forpligtelser. Vedtægterne vedtages på generalforsamlingen, og oftest er de tinglyst på hver enkelte ejerlejlighed.

Den 1. juli 2020 trådte en ny ejerlejlighedslov i kraft. Den beskriver overordnet disse rettigheder og forpligtelser og fastsætter regler for opdeling af ejendomme og oprettelse af ejerlejligheder. Yderligere blev der som en del af ejerlejlighedsloven udarbejdet og vedtaget en normalvedtægt for ejerforeninger.

Normalvedtægten regulerer samtlige generelle forhold for ejerforeninger, og den har været gældende siden 1. januar 2022. Ejerforeninger skal ikke godkende eller tinglyse normalvedtægten, for at den finder anvendelse. Normalvedtægten er gennemarbejdet, fyldestgørende og den præciserer nogle områder, som sædvanligvis kan give anledning til tvivl.

Tag stilling til den nye normalvedtægt

Det er vigtigt at bestyrelsen i ejerforeninger tager stilling til, om normalvedtægten er fyldestgørende og relevant på alle punkter for netop deres ejerforening. Ejerforeninger kan erstatte samt tilføje yderligere punkter, der er relevante for den individuelle ejerforening. Disse afvigelser fra normalvedtægten kaldes en særvedtægt. Størstedelen af alle ejerforeninger har behov for en særvedtægt, der regulerer individuelle forhold som for eksempel:

Begrænsning af udlejning
Ejernes eksklusive brugsrettigheder
Fordelingstal
Stemmeregler der tager højde for ejerforeningens størrelse

Særvedtægten skal vedtages ved gyldig beslutning for at være gyldig overfor medlemmerne, og skal som udgangspunkt tinglyses, for at være gyldig overfor nye ejere eller andre der opnår rettigheder over en ejerlejlighed.
